6. Loaner Car Terms & Conditions
Applies when loaner vehicles are issued:
A. Eligibility
- Must be 18+ with valid driver’s license
- Must provide full-coverage insurance or accept liability
- A drop-off form must be submitted for eligibility
B. Fuel & Mileage
- Return vehicle with same fuel level; otherwise, $5/gallon + $20 fee applies
- 100-mile/day limit; excess at $0.30/mile
- No long-distance/commercial use without written approval
C. Return Conditions
- Return on time or incur late fees
- No smoking or unsecured pets ($250 cleaning fee)
- Vehicle is inspected on return
- We are not responsible for left belongings
D. Violations & Liability
- You are responsible for all citations, tolls, and damage
- Your insurance is primary; otherwise, personal liability applies
- Restitution includes market value, finance payoff, and replacement costs
- Medical expenses related to use are your responsibility
E. Accidents & Total Loss
- Report any accidents within 24 hours with a police report
- If totaled, you/your insurer are responsible for:
- Market value
- Outstanding loan balance
- Replacement vehicle costs (e.g., down payment, taxes)
F. Acknowledgment
Receiving a loaner or submitting the drop-off form confirms your agreement to these terms.
7. Rental Car Terms & Conditions
Applies to all paid vehicle rentals:
A. Eligibility
Must be 18+ with valid license; must have proof of insurance or purchase our optional plan with $1,000 deductible
B. Rates, Fuel & Mileage
- Rates vary by vehicle type and availability
- Fuel must be returned to the same level, or market-rate + $20 fee will apply
- Mileage limits may apply; overages billed at $0.30/mile
C. Return, Smoking & Pets
- Return on time and to the agreed location
- Smoking and unsecured pets are prohibited; cleaning fees apply
D. Liability & Accidents
- Renters are responsible for all damages unless covered by insurance
- Report any accident within 24 hours with a police report
- If totaled, renter or insurer must cover full vehicle value and loss of use
E. Acknowledgment
Use of rental vehicle indicates agreement to all terms and liability acceptance.
8. Loss of Property & Vehicle Damage
A. Personal Property
We are not responsible for items lost or stolen from vehicles on your property
B. Vehicle Damage
Customers must carry valid insurance to cover all risks while their vehicle is in our possession.
C. Employee Injury Liability
Customers are liable for injuries to our staff caused during pickup/drop-off, test drives, or repair if their insurance does not provide coverage.
9. Specific Service Cases
A. Transmission Fluid Change
We are not responsible for any transmission issues arising from sediment dislodgement following delayed fluid replacement.
B. Restraint System / Airbag
You assume responsibility for any airbag deployment or injuries during service on a malfunctioning airbag system.
C. Customer-Supplied Parts
Using your own parts:
- Voids our part warranty
- May result in additional labor charges
- Makes you responsible for replacement of defect-related parts
D. Payments
- We accept cards, financing, insurance and warranty providers
- You are liable if your payment provider declines coverage
- In such cases, we may repossess the vehicle and apply mechanic’s lien and storage fees
E. Storage & Late Fees
- Storage charges begin after 5 business days following completion unless accommodations are made with staff
- Late payment fees apply unless accommodations are made with staff
F. Warranty
Warranty is offered only on parts and labor provided by us and varies by service type. Would not exceed initial amount paid for work order.
G. Delivery Timeline
Job completion is contingent upon parts availability and supplier timeliness.
10. Vehicle Photo & Video Authorization
By submitting your vehicle for service, you authorize Marlboro Auto Repair to take photos and/or videos for:
- Documentation
- Insurance purposes
- Marketing
11. Abandoned Vehicles
Vehicles left more than 30 business days awaiting authorization for repairs or unable to contact the customer or post-completion without full payment or communication, may be deemed abandoned. In such cases:
- Daily storage charges continue
- We reserve the right to file for a mechanic’s lien, tow, or legally dispose of the vehicle as permitted by law
12. Consent to Electronic Communication
By using our services or providing contact information, you consent to receive:
- Service-related emails or texts
- Appointment reminders and updates
- Promotions (optional; you may opt out)
13. Diagnostics Without Full Authorization
If you decline recommended diagnostics or limit inspection scope:
- We are not responsible for missed or undiagnosed issues
- No performance guarantee is made unless full diagnostics are completed and diagnostic fees paid
14. Right to Refuse Service
We reserve the right to refuse service to:
- Abusive or threatening customers
- Individuals who fail to comply with our policies
- Situations that may endanger staff, property, or reputation
15. Vehicle Contents & Security
Customers are responsible for removing all valuables before service. We do not guarantee recovery or protection of personal items left in vehicles, even if stored indoors or secured.
16. Changes to Terms
We reserve the right to update these Terms of Use at any time without notice. Continued use of our Website or services indicates acceptance of revised terms.
17. Governing Law
These Terms are governed by the laws of Prince George’s County, Maryland, without regard to conflict-of-law principles.
